Models Cyprus is an online modelling platform operated by CREATEAGENCY LTD, a company registered in Cyprus under Company Registration Number HE 483989 and Tax Identification Number 60267355M, with its registered address at 13 Amazoniou, Sofokleous, 8025, Cyprus.
Models Cyprus is not a registered modelling agency and does not act as an employer, recruiter or exclusive agent. It operates as a non-exclusive facilitation marketplace connecting freelance models, creatives and clients, including brands, agencies, photographers, production companies and event organisers.
By accessing the website, creating an account, purchasing a membership, submitting a profile, applying for an opportunity or accepting a booking facilitated through Models Cyprus, you agree to be bound by these Terms & Conditions. Our Privacy Policy and Cookie Policy explain how personal data and cookies are handled.
If you do not agree with these Terms, you must not use the platform or its services.
Platform Nature and No Employment Relationship
Models Cyprus operates as a digital marketplace and professional community platform through which models may showcase their portfolios, receive casting opportunities and connect with third-party clients.
Models Cyprus does not guarantee bookings, employment, work, income, exposure or any particular result.
Models using the platform act as independent freelancers and are responsible for their own taxes, insurance, permits, professional obligations and legal compliance.
Models Cyprus does not employ models and does not represent models on an exclusive basis.
Unless expressly stated otherwise in a quotation, booking confirmation or separate written agreement, the underlying working relationship is formed directly between the model and the client. CREATEAGENCY LTD may nevertheless act as the booking coordinator, production coordinator, payment administrator and commercial usage rights administrator for bookings facilitated through Models Cyprus.
Nothing in these Terms creates an employment relationship, partnership, joint venture or exclusive representation arrangement between a model and CREATEAGENCY LTD.
Eligibility and Junior Models
Users must be at least 18 years old to create and manage their own Models Cyprus account.
Where a model is under 18 years of age, the account, profile, booking approvals and usage rights must be managed and approved by a parent or legal guardian.
By registering a junior model, the parent or legal guardian confirms that they:
- Have legal authority to act on behalf of the junior model;
- Consent to the creation and publication of the junior model’s profile;
- Approve any applications, bookings and commercial usage rights;
- Will comply with all applicable safeguarding, supervision, education and working-time requirements; and
- Will attend or arrange appropriate supervision for bookings where required.
Models Cyprus may request proof of age, identity or parental authority before publishing a profile or confirming a booking.
Membership Plans and Subscription Payments
Models Cyprus operates on a subscription-based membership model.
The available membership plans, prices and included features are displayed on the website or at checkout and may be updated from time to time.
Membership features may include profile creation and visibility, access to booking opportunities, casting alerts, social media promotion, homepage placement, WhatsApp notifications and premium opportunity notifications.
Membership payments are processed through trusted third-party payment providers.
Subscriptions renew automatically at the applicable billing interval unless cancelled before the next renewal date.
Members may cancel their subscription at any time through their account or by contacting Models Cyprus. Cancellation will normally take effect at the end of the current paid billing period.
Cancelling a subscription does not automatically remove any outstanding booking, payment, commission, confidentiality or usage rights obligations.
Refund Policy
Consumers purchasing a membership online may have a statutory 14-day right to withdraw from the service contract, subject to applicable conditions and exceptions. Nothing in these Terms limits a mandatory consumer right.
Except where a statutory withdrawal, refund or other mandatory consumer right applies, subscription and membership payments are non-refundable once the relevant membership services have commenced.
Refunds will not normally be issued for:
- Partial use of a billing period;
- Failure to cancel before a renewal date;
- Failure to secure bookings;
- Dissatisfaction with the number or nature of opportunities available;
- Failure to use the membership;
- Rejection of a profile that does not meet platform requirements; or
- Suspension or termination resulting from a breach of these Terms.
Where a consumer asks us to begin providing membership services during a statutory withdrawal period, we will obtain the required express request. If the consumer withdraws before the service has been fully performed, a proportionate charge may apply for services already supplied where permitted by law. The right of withdrawal may be lost after full performance only where the consumer has given the required prior express consent and acknowledgement. Any separate supply of digital content will be handled under the rules applicable to that content.
Wrongful or duplicate charges will be investigated and may be refunded where appropriate.
Nothing in this section limits any mandatory rights available to consumers under applicable law.
Profile Creation and Approval
Users must provide accurate, complete and current personal, portfolio and contact information.
Models Cyprus may review submitted information and content, edit formatting for quality or consistency, request additional information, reject content that does not meet platform standards and suspend or remove profiles that violate these Terms.
A private profile preview may be provided before publication. The user remains responsible for verifying the accuracy of all information displayed on their profile.
Users must promptly inform Models Cyprus of any material changes to their appearance, measurements, availability, location, contact details or other relevant information.
Models Cyprus may decline or remove any profile at its reasonable discretion where necessary to protect the quality, safety, legality or reputation of the platform.
Bookings, Payments and Commission
Models Cyprus facilitates and coordinates bookings between models and clients.
All booking details should be agreed in writing, including where applicable:
- The date, time, duration and location;
- The services required from the model;
- The model’s attendance or performance fee;
- Travel, accommodation and other approved expenses;
- Cancellation terms;
- Commercial usage rights;
- Exclusivity requirements;
- Payment terms; and
- Any special production or wardrobe requirements.
Clients may pay models directly unless CREATEAGENCY LTD has been appointed to administer the booking or the parties agree otherwise in writing.
Where CREATEAGENCY LTD administers a booking, production agreement or Commercial Usage Fee, the client may be required to pay CREATEAGENCY LTD directly. CREATEAGENCY LTD may issue quotations, booking confirmations and invoices and may collect and administer the relevant payments.
Unless otherwise agreed in writing, Models Cyprus charges the model a standard facilitation commission of 25% on the total gross amount payable to the model for bookings arranged through the platform. This may include attendance fees, performance fees, Commercial Usage Fees, renewal fees and other model-related compensation.
The applicable commission will be disclosed at the time of booking or through the relevant quotation, booking confirmation or platform communication.
CREATEAGENCY LTD may deduct the agreed commission and any other expressly authorised charges before remitting the remaining balance to the model.
CREATEAGENCY LTD may also charge clients separate coordination, production, administration or service fees where these are disclosed in the relevant quotation or agreement.
CREATEAGENCY LTD does not hold funds in escrow. Unless CREATEAGENCY LTD expressly guarantees a payment in writing, it is not responsible for a client’s late payment, non-payment, cancellation or insolvency.
Any payment received on behalf of a model will be administered in accordance with the applicable booking terms and subject to clearance of the client’s payment.
Models are responsible for issuing any legally required documentation and for declaring and paying their own taxes, social insurance contributions and other obligations arising from their income.
Commercial Usage Rights and Photoshoot Content
All commercial use of a model’s name, image, likeness, voice, performance, photographs, videos or recordings created in connection with a booking must be agreed in writing.
Commercial Usage Rights are separate from the model’s attendance or performance fee unless the relevant quotation or booking confirmation expressly states otherwise.
Commercial Usage Fees may be calculated according to factors including:
- Duration of usage;
- Countries or geographical territories;
- Advertising media and platforms;
- Campaign scale and advertising spend;
- Paid or organic distribution;
- Exclusivity;
- Industry or product category;
- Renewal or extended usage; and
- Perpetual usage or full-buyout requirements.
The Models Cyprus Commercial Usage Rights Policy may be incorporated into a booking where it is referenced in the relevant quotation, booking confirmation, agreement or written communication.
Model’s appointment of CREATEAGENCY LTD
By accepting a booking arranged or facilitated through Models Cyprus, the model appoints CREATEAGENCY LTD as their non-exclusive booking and commercial usage rights administrator for that specific booking.
The model authorises CREATEAGENCY LTD to discuss, negotiate, document, quote, invoice, collect and administer booking fees and Commercial Usage Fees on the model’s behalf, subject to the model’s approval of the applicable usage scope.
The model retains their personal rights in their name, image, likeness, voice and performance except for the specific rights expressly licensed in writing for the confirmed booking.
No perpetual usage, full buyout, exclusivity arrangement or materially expanded commercial licence will be approved on behalf of a model without the model’s recorded written approval.
Model approval may be provided by electronic signature, email, platform confirmation, electronic message or another recorded form of written communication.
Rights granted to clients
A client receives only the rights expressly described in the applicable quotation, booking confirmation, content release or usage agreement.
Unless expressly agreed otherwise, usage rights are:
- Limited to the agreed purpose, media, duration and territory;
- Non-exclusive;
- Non-transferable; and
- Non-sublicensable.
The client does not acquire ownership of the model’s image, likeness, voice or performance.
A perpetual licence or full buyout does not transfer ownership of the model’s image or personal rights unless an express and legally valid transfer is separately agreed in writing.
Copyright or other intellectual property rights belonging to a photographer, videographer, production company or other content creator are separate from the model’s image and likeness rights and must be obtained from the relevant rights holder where required.
Restricted and additional usage
Content may not be used beyond the agreed scope without further written approval.
Unless expressly approved in writing, clients must not:
- Extend the usage period or territory;
- Use the content through additional media or advertising channels;
- Transfer, sell, sublicense or supply the content to an unrelated third party;
- Use the content for an unrelated brand, product or campaign;
- Use the content in a misleading, defamatory, unlawful, pornographic or discriminatory manner;
- Materially manipulate the model’s appearance;
- Create synthetic, AI-generated or deepfake content using the model’s likeness; or
- Use the content to train an artificial intelligence or machine-learning system.
Any renewal, extension or change of usage may incur additional Commercial Usage Fees.
If commercial usage terms have not been agreed in writing, the client must not commercially publish, distribute or advertise the content until written authorisation has been obtained.
Unauthorised or extended usage may result in additional charges, termination of the licence and the exercise of any contractual or legal remedies available to the model or CREATEAGENCY LTD.
Content Ownership and Platform Licence
Users retain ownership of the images, videos and other content they submit to Models Cyprus, subject to any third-party rights.
By uploading or submitting content, the user grants CREATEAGENCY LTD and Models Cyprus a worldwide, non-exclusive, royalty-free licence to host, reproduce, resize, format, display, distribute and promote that content for the operation and marketing of Models Cyprus.
This platform licence may include use on:
- The Models Cyprus website;
- CREATEAGENCY LTD websites;
- Social media accounts;
- Casting and booking communications;
- Promotional materials;
- Digital advertisements;
- Portfolios and case studies; and
- Relevant partner or client communications.
This licence continues while the user’s profile or membership remains active. Content already included in completed marketing materials, historical social media posts, booking records or legal and accounting records may be retained where reasonably necessary.
Users confirm that they have the necessary ownership, permission, licence or consent to submit all content supplied to Models Cyprus.
Users must not upload content that infringes copyright, privacy, confidentiality, trademark or other third-party rights.
Booking Cancellations, Disputes and Non-Attendance
Booking-specific cancellation terms should be stated in the applicable quotation, booking confirmation or agreement.
Models must attend confirmed bookings on time and remain available for the agreed duration unless prevented by illness, emergency or another circumstance reasonably outside their control.
Models must notify Models Cyprus immediately if they cannot attend a confirmed booking.
Repeated late cancellations, non-attendance, unprofessional conduct or failure to communicate may result in suspension or removal from the platform.
Where a model or client cancels a confirmed booking, any cancellation fee stated in the booking terms may become payable.
Models Cyprus may assist with communications and dispute resolution but does not guarantee that a dispute will be resolved.
Non-Circumvention and Community Standards
Users must act professionally, honestly and respectfully.
The following conduct is prohibited:
- Providing false or misleading information;
- Harassment, abuse or discriminatory conduct;
- Fraudulent activity;
- Breaching agreed booking or usage terms;
- Unauthorised use of photographs, recordings or personal information;
- Circumventing Models Cyprus to avoid agreed commissions or fees;
- Directly rebooking a client or model introduced through Models Cyprus for the purpose of avoiding platform obligations; and
- Conduct that may endanger another person or damage the legitimate reputation of Models Cyprus or CREATEAGENCY LTD.
Where a client or model is introduced through Models Cyprus, any applicable commission and booking obligations remain payable for bookings arising from that introduction, unless otherwise agreed in writing.
Breaches may result in cancellation of a booking, suspension or termination of an account, additional charges or appropriate legal action.
Privacy and Personal Data
The use of Models Cyprus is governed by the Models Cyprus Privacy Policy, which explains how personal information is collected, used, stored, shared and protected.
Personal data may be processed where necessary to:
- Create and administer profiles;
- Manage memberships;
- Coordinate castings and bookings;
- Communicate with models and clients;
- Verify identities and approvals;
- Prepare agreements and quotations;
- Administer Commercial Usage Rights;
- Issue invoices and process payments;
- Maintain legal, tax and accounting records;
- Prevent fraud and protect the platform; and
- Resolve complaints, payment issues or usage disputes.
By using the platform, users acknowledge that their information will be processed in accordance with the Privacy Policy and applicable data-protection law.
Electronic Communications and Acceptance
Users agree that contracts, booking approvals, usage approvals, notices and other communications may be provided and accepted electronically.
Electronic acceptance may include:
- Selecting an online checkbox;
- Submitting an online form;
- Confirming through the platform;
- Signing electronically;
- Confirming by email; or
- Providing clear written confirmation through an electronic messaging service.
Electronic records may be retained as evidence of acceptance, consent, booking terms and usage approvals.
Users are responsible for keeping their email address, telephone number and other contact information accurate and up to date.
Limitation of Liability
To the maximum extent permitted by applicable law, Models Cyprus and CREATEAGENCY LTD will not be liable for:
- Loss of income, work, opportunity, profit or anticipated savings;
- Personal injury or property damage caused by another platform user;
- Emotional distress;
- Client or model misconduct;
- Payment failures or delays;
- Booking cancellations;
- Contractual or scope disputes;
- Unauthorised use by third parties;
- Inaccurate information submitted by a user; or
- Indirect, consequential or special losses.
Models Cyprus provides platform, promotional, introduction, coordination and administration services but does not guarantee the conduct, suitability, solvency, identity or reliability of any model, client or third party.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law.
Indemnity
To the extent permitted by applicable law, users agree to indemnify and hold harmless Models Cyprus and CREATEAGENCY LTD against claims, losses, liabilities, damages and reasonable legal costs arising from:
- A material breach of these Terms;
- Unlawful use of the platform;
- False or misleading information;
- Content ownership or permission disputes;
- Unauthorised commercial usage;
- Infringement of third-party rights;
- Fraudulent or negligent conduct; or
- A booking-related claim caused by the user’s own actions or omissions.
This provision does not apply to the extent that a claim was caused by the negligence, unlawful conduct or breach of CREATEAGENCY LTD.
Suspension and Termination
Models Cyprus may suspend, restrict or terminate an account where reasonably necessary because of:
- A breach of these Terms;
- Non-payment;
- Fraud or suspected fraud;
- Harassment or unsafe conduct;
- Repeated booking cancellations or non-attendance;
- Circumvention of agreed commissions;
- Unauthorised content usage;
- Legal or regulatory requirements; or
- Conduct that creates a material risk to another user or the platform.
Where reasonably possible, Models Cyprus will notify the user of the reason for the action.
Termination does not affect any payment, commission, confidentiality, indemnity, dispute or usage-rights obligation that arose before termination.
Changes to These Terms
Models Cyprus may update these Terms to reflect changes to the platform, services, pricing, commercial practices or legal requirements.
The updated version and its effective date will be published on the website.
Where an update materially affects a user’s rights or obligations, Models Cyprus may provide additional notice or request renewed acceptance where reasonably appropriate or legally required.
Continued use of the platform after an updated version becomes effective may constitute acceptance of the revised Terms, subject to applicable law.
Changes will not retrospectively alter the agreed commercial terms of an already confirmed booking unless the affected parties agree in writing.
Severability and Entire Agreement
If any provision of these Terms is found to be unlawful, invalid or unenforceable, the remaining provisions will continue in effect.
These Terms, together with the Privacy Policy and any applicable quotation, booking confirmation, Commercial Usage Rights Policy, content release or separate written agreement, constitute the agreement relevant to the services concerned.
Where booking-specific written terms conflict with these general Terms, the booking-specific terms will take priority for that booking.
Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the Republic of Cyprus.
Any dispute arising from these Terms or the use of Models Cyprus will be subject to the jurisdiction of the courts of the Republic of Cyprus, except where mandatory consumer-protection law provides otherwise.
